I received an insurance check made payable to a body shop and my wife and me. The body shop asked my wife and me to sign the check over to them, but I would rather pay the body shop in full with my credit card and deposit the check into my own bank account. However, the body shop says that they cannot do this. Is this true? Couldn't they endorse the check, effectively signing it over to me? If so how would they go about doing this?
Your insurance company wants to ensure that the car is repaired and that there will be no mechanics lien for work not paid for. Assuming this is a reputable company, once the work is completed to your satisfaction, endorse the check, take your car and let the body shop deposit the check. This is a common practice. Yes, the body shop could endorse it, but your bank may not accept it if they can't verify that endorsement.
