I have a mortgage refund check that I want to cash. The problem is that my ex-wife's name is on the check with mine. I have been told that I would be able to cash this check with my signature only since the check doesn't state "and" or "or" between our names. Is this true? If not how do I go about doing this?
If two payees are listed on a check without any symbol or the word "and" between them, the Uniform Commercial Code states that either of the two payees may endorse and negotiate the check.
However, there is no rule that says that a bank must accept such an endorsement, or for that matter, accept the check at all. Take the unendorsed check to your bank and ask them if they will accept it for deposit with your endorsement only. If your bank won't accept it with just one endorsement, and if the bank on which the check is drawn is close enough, go there to ask the same question.
