My father has a check that requires both his and my mother's endorsement. My mother passed away in January 2007, and the check requires ID. The check cannot be reissued, and he is the executor of my mother's estate. How do we go about negotiating the check?
Assuming your father has an account with a bank who both knows him and that your mother has died, he should take the unendorsed check to that bank and ask them to accept it for deposit to his account. Assuming that the bank says it will accept the deposit, your father should first endorse the check as follows:
Pay to [name of bank]
[Your mother's name]
by [your father's signature]
Executor of the estate of [your mother's name].
Then your father can endorse the check in his own name.
