You can, and it might actually clear, but there's also a possibility that the bank on which it's drawn will refuse to pay it. Your employer or former employer would probably like to learn that the check has finally been paid. Contact the company to find out if they've stopped payment on it. If not, and if you don't mind disciplining yourself not to use the funds for a few days, go ahead and deposit it. If the check is local, a week should be long enough. If it's drawn on a distant bank, wait two weeks. If you'd rather not wait to access your funds after depositing your check, you can ask the issuer to re-issue the check, but they'll only do that if you first return the original.
