Who is Liable for Missing Check?

The company that I work for claimed that they sent my check in the mail, but I have yet to receive it. If it comes up stolen who is liable? If it is cashed, can I still get paid?


The company remains liable until you receive the check deposit or cash it. If it is negotiated with a forgery of your signature, the party who accepted the check from the forger will be liable, and your employer should issue you a replacement.

Talk to your employer about the possibility of having future payroll amounts directly-deposited to a bank account. That eliminates the possibility of a check getting lost in the mail.
