I am going to receive a check from the State of New York that will be made payable to my mother's estate. My mother passed away in 1989, and the estate was properly probated and closed in 1990. Is there any way to deposit this check without having to open an estate account? Is there an heirship affidavit for this, as there are no titles to transfer?
You may be able to deposit the check if you can arrange to have it endorsed to you by the estate's personal representative, and then endorse it yourself. It will be up to your bank to decide whether to accept it for deposit, so you need to discuss this problem with the bank before anyone endorses it. If you can't negotiate the check in that way, you may have to go through the motions of opening up an estate account.
