My father recently passed away. He was unmarried and I am his only child. He did not have a bank account, but left uncashed checks payable to him for contract work he had performed. The least difficult way to proceed is to approach the persons who issued those checks, explain the circumstances, and ask to have the checks re-issued to you. As for your last question, that's a state law issue. You might be able to get a quick answer at the county probate court.
