Obtaining Funds from Stolen Paycheck

I did not receive my last paycheck from my employer, and when I contacted him about it, he told me that it had been cashed without any signature on the back. How can I find out who cashed it? How do I go about getting my funds from the check?


You should ask your employer to help you file a forged endorsement claim on the check. This is an affidavit you complete and your employer files with the check at his bank. His bank reimburses your employer and forwards the claim to the bank that accepted the check for endorsement. Your employer should provide you a replacement check.

Your employer's bank will be able to identify the bank that accepted the deposit of the check. Try to find out where that bank is located, and contact it. Explain the problem and tell them that you are concerned your identity may have been stolen and used to open an account. That step should not be needed for you to get your money, but it could prevent the crook from using that account again.

See if your employer will direct deposit your payroll checks. This will prevent a check from being intercepted and misdirected.
