My husband’s bank allowed him to deposit an insurance check made out to both of us into his personal checking account without my endorsement. They have done this several time with joint tax returns.
I have spoken to the bank manager and told him to never cash a check without my endorsement if my name is on it. What should I do now? Can I get this money back?
If you have not received what was due you from jointly-payable checks, you should contact the parties who issued them, including tax authorities. The time limits for doing so vary, but doing so sooner is always better than waiting.
The issuer of such a check may ask you to provide an affidavit that you didn't endorse the check and that you received no benefit from the check. That affidavit will allow the issuer to request reimbursement from its bank, and trigger a claim by that bank against the bank where the checks were deposited (and ultimately, recovery from your husband's account). The issuer may reissue a check to you right away or wait until it has recovered funds from its bank, but taking this action will get attention!
