I recently sold my car and the person paid me with a credit cardcheck. I held the title and the car until my bank made the funds available on Saturday. I then gave the man the car and title and he drove off. On Monday the money was pulled back out of my account and I had no money, title, or car.
The check had a stop payment on it. Is my bank liable for making the funds available? I waited five days to see if the check was good and assumed that it was when they released the funds. What should I do now? How can I get the money for my car?
This matter is between you and the party who gave you the check. Hold on to the stopped check. You can use it if you have to charge this person with theft by check.
It may be that the purchaser has a complaint about the car, and wants to adjust the purchase price, or to undo the deal, or, as you fear, it may be that he has deliberately scammed you. Start by trying to contact him to see what he has to say. If, as you fear, he has scammed you, contact the police.
