I wrote a check on June 23rd, post-dated for June 27th, four days later, but it was cashed next day, June 24th. When I brought this up to my bank, they said its immposible to check all dates on checks and it's totally legal for this check to have been cashed. Is this correct?
Yes. In most states a post-dated check is an agreement between the party who wrote the check, and the one to whom it is paid. The bank is not bound to review the date.
Many banks will allow you to contact them and place them on notice that this post-dated check is outstanding and that you don't want it paid before the date specified. Most banks will charge you a fee and handle this as a stop payment request until the pay-date is reached, then the flag is released and the check can pay as normal.
