If the check in question was posted to your account on Tuesday, December 23, your bank had until midnight on Wednesday, December 24, to return it. After that, your bank was accountable for the amount of the check.
That midnight deadline applies whether your account was overdrawn on the morning of the 24th or became overdrawn later. Midnight on the 24th was the deadline. If your account had a good balance and the check was not overdrawn, you could have a valid argument that the bank wrongfully dishonored your check.
