Old Check Paid from Account: Can I Reverse It?

My bank just paid a 2 and 1/2 year old (Dec. 2006) outstanding check from my account. Although I currently had the funds to pay the amount, this unexpected withdrawal is likely to cause an overdraft in the very near future. Can I expect the bank to return my money upon my insistence?

Your bank is very unlikely to reverse their payment of the check, since it won't be able to recover the funds. It's been a fact of banking life for several years now that banks don't pay a lot of attention to check dates, and have the right to pay checks that are older than six months old and even checks dated in the future. Only when there is a stop payment on a stale check or an alert from the customer on a postdated check, will the bank be liable to its customer if the check is paid. Try to move funds into your account to prevent going overdrawn. If you have any other old checks outstanding, make sure you have funds in your account to cover them, or put a stop payment in place to prevent payment, and keep the stop in place (renewed as needed) for as long as you are concerned that the check might get presented for payment.
