Can you tell me if a bank can cash a check that is older than six months on a closed account? It wasn't returned; they paid the funds.
If the account was truly closed, it would have been wrong for the bank to pay the check. After all, it no longer had a contractual right to pay it. However, banks often take some time to truly close accounts; certain processing cycles have to be completed unless the bank uses a short-cut to force an account to close quickly.
If the account was not truly closed, the bank had the legal right to pay the check and allow the account to go overdrawn. If you obtained the benefit of the check's being , credit with another bank or with a third party, for example, your argument against the bank will be weaker than it would be if you actually sustained a loss.
