I wrote a check for $1000 to a local car dealership as an earnest payment. I ended up not purchasing the vehicle, but the dealership cashed the check anyway and refused to give me my money back. Do I have any recourse?
That would be a contract issue and it depends on if the terms allow for a refund based on that particular car not being sold and why. I will say that in my area car dealers do not get earnest money. They may get a deposit as a show of faith to hold a car, but nonrefundable earnest money seems unusual.
