Check to Company, Cashed by Liquidator: Now What?

I recently purchased furniture from a retailer "Abc Furniture". I paid with a check made out to Abc Furniture. Just a few minutes after I completed my order, I learned that the store was being liquidated, and there's a good chance that I will not receive my furniture as promised.

I tried to cancel the order, but Abc Furniture refused. I tried to stop payment, but the check cleared the same day.

When I got the copy of the cashed check from my bank, Abc Furniture was stamped over with the name of a liquidation company. Since I didn't write the check to the liquidator, but they cashed it, can I cancel that transaction?


At best you could claim the check was altered and pursue a claim with your bank that way. The liquidator will likely be able to prove they legally represented the dealer and you'd lose. If you went to court and could prove they took your funds with no intention of delivering what you purchased, that might be a strong case.
