Is it fraud if I wrote a personal check to another person for $190, dated 9-6-08, and that person waited a year and then changed the date to read 9-6-09 before cashing it?
If the payee has received payment from you in another way, such as a replacement check or cash, before altering the date and cashing the check, his actions would be fraudulent. However, if you still owed the money to him when he cashed the check, there would be no fraud involved.
