Bank Admits Error, Still Wants Payment from Me

I wrote a check to my landlord that clearly states $900.00, both in numbers and words. The bank cashed the check for $9.00.

I contacted them about this and they said it was their error. I waited two months for them to fix the error or to contact me and they never did. Now that I moving, they realized the error and want the remaining amount.

Do I legally have to pay them the remaining amount? They cashed the check and it was an error on their end. Am I liable?


Yes you are liable. If your landlord only received $9.00, you owe him rent. If your landlord got the full $900.00 and the bank is out $891.00, you owe the bank and it is entitled to recover it from you.

Your bank's mistake doesn't get translated into a windfall for you. Pay up, and get a receipt.
