Check Bounces: Is that My Fault?

Can maintenance charges in case of a Cooperative Society be paid through check? I made a payment of society maintenance charges through check dated 10/22/2009 to our society's secretary, but the secretary did not deposit it until a month later. It bounced due to insuffient funds. Whose mistake is it, the secretary's or mine? The secretary is now saying that in future he will not accept any payment through check.


That there be sufficient funds in your current account for the payment of checks you've issued is your responsibility. There is no mistake on the part of the payee in failing to deposit the check for a month, although it would clearly have been wiser to do so immediately, so it seems that the error is yours. If your payment record over the next several months is unsullied, the secretary may decide to reinstate your privilege of paying by check.
