I read your endorsements section, and I understood it, but why doesn't my bank? They allowed two checks to be deposited against my account that I wrote back in the year 2000 and 2001, which were endorsed "For Deposit Only". They said because they were deposited through the ATM, that is why they were accepted and they have the option of paying or returning them. Can you help? I just filed a complaint with the Federal Reserve.
Unless your bank knew that you didn't want those checks paid, the Uniform Commercial Code gives the bank the right to pay them against your account regardless of the old dates, if it does so in good faith. When a bank is given a stale check for deposit at a teller window, the teller has the opportunity to see the check date and refuse to accept it for deposit, knowing that it might not be paid, but there is no such opportunity when a check is deposited at an ATM. In this case, the bank acted appropriately under the circumstances.
