Person Loses Check, then Sues Check Writer

I wrote a check to a former friend, who lost it. Now, six years later, she found it. She is now taking me to court, after trying to cash it on an account that I closed three years ago. Is there a legal time limit that she had to cash this check?


The time limit will depend on state law. Your liability could also depend on whether the check was issued to pay money you owed your friend, or if it was simply a loan or gift.

Show up in court if you get a summons, or you could risk having a judgment entered against you before telling your side of the story. Check with legal counsel if the amount in question is worth the added expense.
