I recently wrote a check to a roofing company, who cashed it, and the next day closed their doors and filed bankruptcy. I filed fraud with the bank just so they would investigate the check. The online image has no information (just a black ink spot). There is no endorsement or trace information. The bank can't tell me any information. I want to make sure that the roofing company cashed it and not an individual. What information does the bank have to legally provide me? Is it illegal for them to cash a check with no endorsement on the back? I am wondering if legally I have any recourse against the bank since the back of the check is blank. The fraud department seemed to not look at it much, and I have to provide the police with some more background information on it.
A check can be deposited to an account of the payee without an endorsement. The bank accepting the check (or cashing it) provides a warranty that it did so for the payee as its customer. You have a claim in bankruptcy against the roofing company. Contact an attorney for advice on how to proceed. You do not have recourse against your bank.
