Can a private club, (in this case, a children's swim club) ask for a post-dated check for payment and hold it until the payment date arrives?
State law may affect the answer to this question. We aren't aware of any federal law that would prohibit a request for a post-dated check, but cannot recommend that anyone comply with such a request.
Issuing a post-dated check is risky if the issuer is depending on being able to cover it with a deposit before the date on it. There's nothing to prevent the payee from depositing the check early, or the paying bank from paying the check before that date, even if it creates an overdraft.
