Not Notified about Unusual Activity

A family member used my credit card. The credit card company never notified me that my account was way over the limit. They are supposed to notify me when there is unusual activity, but never did. How can I hold them responsible?


It is doubtful that you will be able to hold the credit card issuer responsible, because their card agreement is carefully crafted to protect the issuer. Transaction alert services are usually offered with a lot of "wiggle room" for the card issuer. However, if you believe that statements made in writing by the issuer provided a promise to notify you of the activity that you've described, and you can verify that it never gave you notice, you might have some leverage with the issuer. Whether that would ever rise to the level of getting you off the hook for the transactions in question is another matter.

Were the transactions by your family member done with your authorization? Did you tell him or her that using the card was OK? If not, you can dispute the charges as unauthorized. Be aware, though, that the credit card issuer will have the right to attempt to recover the funds from the individual who actually made those transactions.
