Ex-husband Overdraws Child Support Account

I set up an account with my ex-husband so that he could deposit child support checks to a bank that has branches in towns where we both live. He has a business account at the same bank. A few months ago, he went negative and the bank took funds from the child support account. I called the bank and explained the situation, and they reversed the funds. Its happened a second time, and all the checks I wrote bounced, and I'm left with many NSF fees. I live in Massachusetts. I'm also the primary signer on the account. What is the responsibility of the bank? Can this be reported?

If the business account is in your husband's name (as a sole proprietor), the bank has the right to offset an overdraft in that account against the personal, joint account he shares with you. That would make the problem between you and your ex-husband. Don't blame the bank for his failure to maintain his other properly.
