Cashing Check Received 4 Years Too Late.

My mother just received a check from a settlement in 2002. She passed away in 2005. Am I able to cash this check as her executrix?

That depends on whether your authority as executrix of your mother's estate is still valid. Depending on your state and whether you have already completed the settlement of her estate, your appointment may have lapsed. If the settlement terms provide for payments after your mother's death, those payments should be to her estate.

If you aren't certain of the terms of the settlement, check with an attorney. If your mother was represented by an attorney when she obtained the settlement, he or she might be your best source of information. It's possible you'll need to return the check to the remitter in order to have it reissued if the estate is entitled to the payment.
