My son died one month ago. All I have is a few papers listing accounts and credit cards. He had no property or money in his accounts. All I want is a copy of his bank statement so I can see if he made payments on a life insurance policy his girlfriend said he has. The bank needs letters of testementary, which are for probate court for estates. He has no estate. How can I get his statement without the court's involvement?

You are in a difficult position. Without letters of testamentary, no one has a right to the account information. While the bank doesn't want to be difficult, it really has no legal ability to give you that access, and if a compassionate individual at the bank were to research the account to tell you if payments had been made to an insurance agency or company, it could be stepping into a legal problem of its own.
Since you said your son's girlfriend seems to know something about a life insurance policy, can she shed any light on it, such as the name of the agent or company that your son may have contacted?
