Cashing Warranty Check of the Deceased

I have a check for $250 from my dad's car warranty policy made out to him since the warranty was in his name. I can't cash it because he is deceased, and they won't reissue it under my name. Where can I cash it? Could I bring a death certificate and my ID to prove he is deceased and that I'm his son? This is very frustrating. There is no power of attorney. I just want to cash this check.


The check cannot be cashed or deposited except by the personal representative of your father's estate. If no probate of his estate was opened, and there is no court-appointed executor or administrator, check with the probate court in your county or parish to find out if your state has any sort of "probate-lite" provision for small estates. Then weigh the cost of such a proceeding or full probate if there's no small estate provision, against the benefit of getting the warranty check and any other loose ends finalized. Incidentally, a power of attorney wouldn't have helped anyhow, because it would be ineffective after your dad's death.
