Cashing Check Made out to Estate

My father was killed in a motorcycle accident. The bike insurance company will not make a check payable to me, only to the estate. There is no estate. My parents were married at the time of his death. Can my mom cash the check?


The only individual who can endorse the check is the legal representative of the estate. Contact the probate court to find out how much it would cost to go through the estate settlement process, so that a representative can be appointed. Weigh that cost against the amount of the check to see if the estate settlement process will be worth the trouble and costs.
