Money Stolen from Account of Deceased

My father passed away 9-28-08, and money was being withdrawn from his account the day after he passed until the account was cleaned out. He was the only person on the account. I'm the only child and he was divorced. I opened a succession, but the money is gone! What do I do now? Is the bank responsible to put the money back in, and do their own investigation?


Your use of the term "succession" suggests that you are in Louisiana, where that term refers to the legal process of entering claims to or against a decedent's estate. If you are the legally appointed representative of your father's estate, you should have a right to demand an accounting from the bank concerning the withdrawals from your father's account after his death. The bank must defend its actions in allowing the withdrawals, and should be able to produce authorization for them. At minimum, the bank should be able to tell you where the funds went, whether or not the withdrawals were authorized.
