Elder Abuse, Unauthorized Withdrawals

My father-in-law recently passed away. In going through his papers, it appears that his bank accepted hand-written notes to make withdrawals and write cashier's checks to be used by people who were taking advantage of him and his illness. Is this legal or do we have a case here?


You didn't say whether the notes were signed by your father-in-law or not. If he signed them, there's probably nothing illegal about the bank's having honored them.

Financial abuse of the elderly is abhorent, but it can often be difficult to detect and prove. Whether your father-in-law's bank should have questioned the hand-written requests cannot be known at this point. If you suspect that individuals took financial advantage of your father-in-law, contact a local office of your state's Office of Elder Affairs for guidance.
