Cashing a Check to an Estate

My significant other died two months ago without a Will. I had two kids with him. State Farm sent me a check made out to his estate for under $100,000 for a property loss we had two years ago. How do I go about cashing it or opening an account without probate?


It's not likely that the insurance company will re-issue the check in your name if the insurance contract was in his. That leaves you only the option of giving the check to the legal representative of his estate for negotiation, and that of course, means that probate will have to be opened. Check with the probate court to see if your state has a "probate-lite" provision in its laws for estates with limited assets.
