My mother-in-law passed away in March. My husband went into the bank with the death certificate to have the account frozen while in probate. We received the letter, and Kevin went into the bank only to learn that the $4,000.00 went down to $700.00. I thought once an account was frozen due to the death of the individual, that nobody could take money out for any reason until the matter is settled. Was this legal?
An attorney can tell you whether the removal of funds from the account was permitted under the laws of your state. The attorney will need to know the circumstances of the withdrawal, including who requested and authorized it, the purpose of the withdrawal, and the specific laws of the state that address the question. Your husband can start the investigation by asking the bank what happened to those funds.
