Executor Empties Account: What can we do?

My mother passed away and had over $62,000 in her account. She added my sister's name to the account after my dad died, under undue influence, which I'm in the process of proving. My sister went in a few days after mom died and withdrew all but $1,000, and did not let them know that she died. I am a beneficiary on the account. I need bank records to get that information for court, how do I do that? I have already hired a lawyer, paid him, and after a year he did nothing. I found out that he had been disbarred. My sister is executor due to undue influence. The letter from mom to the courts prove that. Please help.


Get a new lawyer. As a beneficiary you don't have the rights to ask the bank for its records. You'll have to do that through your lawyer and the court. The bank apparently acted on the orders of an owner of the account. You need to pursue legal actions challenging the way the estate and your mother's assets were handled before and after her passing.
