Government Disburses Funds from Unprobated Will

My mother died two years ago. She had an account which was frozen upon her death. She had a Will, but it was not probated. Now my niece is telling me that the FDIC is using her wishes to disperse the funds in the account. She lived in Washington. I thought the money would go to the Department of Revenue. Can you clarify this? How can a Will be used which was not probated?


Is it possible that the account was designated for payment upon her death? If that's the case, that designation would take precedence over her Will. If the bank was taken over by the FDIC, the agency would have to follow any such account designation if it is able to locate the pay on death beneficiaries.
