Checks to Estate and to Deceased

My husband recently died, and I have a check from our insurance company for a property claim made out to the estate of my husband and to me, and a residual payment check in my husband's name only. How do I go about cashing the checks or setting up an account? We did not have joint accounts.


As they are drawn, those checks can only be cashed or deposited by the legal representative (executor or administrator) of your husband's estate. If the insurance company will reissue the first check, so that it is payable to the estate or to you (rather than and to you), you could negotiate it yourself.

Get an initial consultation with an attorney or visit with the clerk of the probate court to get an idea of what it would cost to open an estate settlement for the purpose of negotiating the checks, and compare that amount with the amount of the checks. Then decide what to do.
