Small Account: No Will: Can I Cash His Checks?

My brother died suddenly in January. He had no Will and only $4.25 in his bank account. However, we have his last paychecks that need cashing (little over $2,000) and we need to have his account closed. If I take a death certificate to his bank, can they cash the checks and close out the account?


Legally, no, those checks belong to your brother's estate. Recognizing that there's not much money involved, certainly not enough to warrant probating the estate unless there are other assets, the bank might find a way to assist you. However, it's under no legal requirement to do so.
