My mother passed away over a year ago. There was no estate, as she had no property. Her Will showed me as the executrix and sole heir. I also had POA for everything for her prior to her passing away. I just received a refund check from the nursing home where she lived for the last nearly two years of her life. It says it is a resident refund. It is made payable to the estate of my mother. Can I deposit this check into my own checking account?
Legally, no, your authority under the power of attorney ended with your mother's demise. Your nomination in her Will to be executrix has no validity unless the Will is taken to court and probated.
You can ask the nursing home whether the regulations it operates under will permit them to reissue the refund in your name, given your status as the only heir. Don't get your hopes up, but you won't know unless you ask.
