Mother Allows Son to do her Executrix Duties

My father passed away about three years ago. My mother was named as his executor; however, she let my brother handle the financial affairs, etc. He did not properly pay twenty-four hour health care providers or report them for an IRS deduction, although they cost about $60K annually. (My mothers retirement was about $30K.) Also, my brother refused to provide me with any information, although I was named in the Will. Now my mother has passed away. He is still refusing to provide any information. He took me to court so that I would not be able to be an executor (although I was named in the Will, as was he and another brother who declined to act as an executor). Now he is dragging his feet with the court appointed executor. I am trying to keep executor costs down and have been told I can assist by finding/providing account numbers for checking, savings or other accounts. I have a copy of both death certificates. Is there some way I can get the account numbers from the banks (I know some of the banks my parents dealt with) to provide to my attorney? Needless to say, I fear my brother(s) were taking funds from my mother.


Other than poring over whatever of your mother's records you can find, as well as scrutinizing any records you are able to obtain from the banks you have already identified for clues, there's not much you can do other than to contact other area banks, share as much of the background information as you are comfortable with, and hope for their cooperation. If that doesn't locate what you need, it may take action by your attorney.
