My father recently passed away, and my brothers and I are listed as beneficiaries on his life insurance policy. One of my brothers is incarcerated. Would I be able to take his portion of the check and open up an account for him in his name?

Opening an account in his name would not be possible without the legal authority to do so. You may need a power of attorney. Having that doesn't mean a bank will accept it, however. If he has no other account to deposit this to, you may end up holding it for an extended time. Verify that the check will still be good when he is released and is able to cash it, and that the funds will not be escheated to the estate, making collection of them a bit more cumbersome.
