I have a question regarding a trust. How would you make a check out to the trust? Can you make it out to the trustee of the trust or do you have to make it out to the trust itself?

Is there a statute for this the previously asked question regarding endorsement of a trust check?

The statute is section 3-110 of the Uniform Commercial Code. The section number may vary in your state.

If the intention is to make a payment to a trust, the check may be made payable in any of these ways:
  1. Payable to the trustee (Sarah Smith, Trustee)
  2. Payable to the trust (Smith Family Trust)
  3. Payable to the trustee, identifying the trust (Sarah Smith, Trustee of Smith Family Trust)


Of the three, the last is the best way to write the check, since it leaves nothing open to speculation.
