My mother passed Jan.2008 she had several CD's POD to me. When my brother the executor closed her checking account the bank gave him the CD's that were POD to me. Is that legal?

It would be appropriate only if your mother had revoked the POD designations on the CDs before her death (which would have been her right). You should contact the bank and ask on what authority the accounts were released to your mother's estate.
