Can a merchant place a second transaction as check number 99 when they were not successful with the first transaction from a check number given originally? In other words are they ALLOWED TO MAKE A NEW CHECK BY PLACING A 99 ON IT FOR IT TO GO THROUGH?

If the item known as a "remotely created check" does not bear your signature, Regulation CC gives you 6 months to contact your bank and state that the item is not authorized. You bank can then return the item back to the merchant.

Before taking this action, consider the consequences. Do you owe the merchant the money? Will you incur additional fees from the merchant if you have the item returned?

Crowman, do you mean the UCC or Reg CC?

In any case, if this is a banker asking, we'd refer you to http://www.bankersonline.com/

You should be more specific if you are processing the check, or writing one that had this happen.

In 2006 Reg CC 229.34 was amended to include remotely created checks. Of course, then you can use the presentment warrenties from UCC 406 to return the item.
