When stress on my family is at it's highest, and a debt collector calls my house, under false pretenses, my wife responds that "he'll call when he returns from being deployed". How much of an invocation of SCRA or SSCRA has been invoked?

SCRA does not exempt collection activities or eliminate payments. Nor does it decrease ones responsibility to contact creditors and work something out.

A service member writting letters home can just as eaisly write one to a creditor and make mutual satisfactory arrangements.

Being deployed is not an I don't have to pay situation. Your credit is being seriously imparied if you ignore your creditors.

I don't see it as trying to invoke SCRA, but you indicate it is fraudulent and that is simply a lie. It is telling the collector not just that person is not here, but that they are serving our country. When that is not true, if that creditor does provide special remedies, you are getting those off false pretenses. I don't know that it is illegal, but it is immoral. Not being able to pay a bill is not a crime, nor is it immoral. Personally I think it is worse than just saying we can't do anything, lets make some realistic payment arrangements so you don't have to call.

Well, if you check out searle v s@p and Citifinancial, you will be amazed at what happens to PAID debts by these companies. (US district court western division of Louisiana)
