Some one I know ( close family member) received a check in the mail for a few grand. She took it to the bank and I know for a fact she didnt endorse it - The teller never said anything. They just deposited it. the check was from a loan company. the back of the check clearly stated that by singing you agree to term of the loan. A simliar message was on the front of the check. I am worried that this person is in big trouble. she seems to think that since the back depostied the check with no endorsement she in the clear. I told her this is wrong and could put her in jail. Who is responsible for making sure the endorsement is there? Worried to death.....

Excuse me but this is posted in another forum leading the reader to believe a bank employeee made that post. I suspect someone is having a bit of sport and no respose is necessary

truth be known I am a teller and my friend asked me to cash a check, she didnt sign it, i cashed it - stupid , i know. I dont know if its going to come back on me. i am trying all avenues to save my butt!! sorry for the double posting

As I responded to your post in security, if you put this through for a friend against bank policy, you most likely have a problem especially now that the bank is out the money due to your friend's actions.

Not very nice of your friend after you put yourself in jeopardy for them.

Why would you knowingly accept it without endorsement? This could come back to bite you.

Why is it bad to not endorse? I have given checks to my bank forgetting to endorse them and they never say anything. In fact, I even came in one time after realizing I forgot to and they told me not to worry about it.

In this case it is a problem because the check represented a loan, activated by the endorsement of the check. This is very common, especially for internet banks. The endorsement was a critical part of the transaction. While I am not a big fan of this process it is really one of the only ways these loans are made. The endorsement is in lieu of a signature on a note, etc.

I am going to speculate that, in a court of law, the depositing into an account bearing the payee's name will serve as an endorsement. It will be proven beyond a reasonable doubt that the customer (payee) received benefit from the negotiation of the check. The loan company will likely have its legal recourse with the payee.

I agree. My comment was more to the point that this person appears to have done this intentionally and the teller, a friend of the depositor, knowingly processed the transaction without endorsement. They are trying to rip off a bank, not a good idea, especially via loan fraud. And the teller who apparently was trying to help a friend now has a problem.

I cannot believe you put your job on the line for something like this. Nowadays, good jobs are hard to come by. But, it appears from this post that good employees are also hard to come by.

I agree, you've knowingly circumvented your bank's internal policies in order to help a friend. If you worked for me and I discovered this, you would be searching for new employment.
