I recently purchased a mattress on a store credit card that the mattress company offered. I HATE the mattress and want to exchange it. Their company policy allows this, for a fee of course ($249.00). The problem is you need to get an even more expensive mattress. The one I like is $250 less than the one I originally purchased and the company will not work with me.

At this point I want to tell them to come pick up the mattress, I'll pay the 'exchange fee" in cash, and just not pay their credit card.

I'll go get my mattress from someone who actually wants my business.

I know regular credit cards offer consumers some protection if a product is defective or there is a problem. Does this work for a store card too?

I would read your contract statement. Does this card go through the visa/mastercard network?

The company is GE Money Bank out of Utah.

There is a section that states special rules for credit card purchases. If you have a problem with the quality of property or services that you purchased with a credit card and you have tried in good faith to correct the problem with the merchant, you may have the right not to pay the remaining due on the property or services.

These limitations do not apply if we own or operate the merchant.

How do I find out if GE Money Bank owns Sleep's?

We are going Thursday back to the store with a letter documenting the facts as we see them. We want them to remove the mattress and reverse the charge on their credit card.

What do you think my chances are for a happy ending?

How long have you had the mattress? Didn't it come with a limited time "satisfaction" guarantee? Usually mattresses do because you don't know if you are satisfied until you sleep on them for several days or even a few weeks. I know when I purchased my mattress set, it came with a 30-day satisfaction guarantee. If I didn't like it, I could return it and exchange it for another mattress, which I did. If you are past your period for this guarantee, then you are more than likely stuck with the offer the company has made.

We purchased it on May 23, 2005 and it was dilivered on May 24th.

On June 2nd, I told the salesman that we didn't like it.

He said our only option was to spend even more money at his store!

We do not want to continue to do business with this company. He stated we were required to sleep on it for 14 days before we could "exchange" it. We want to return it and walk away!!!

I'll let you know what he says after I meet with him Thursday night.

Call the Credit Card company direct. They can let you know if they can help you and what if any documentation they need from you.

Generally, your credit card company will back you up only if something was done wrong or the merchandise was not what it was supposed to be. Was their return policy posted at the register and/or on the receipt? Does it indicate that you must make an exchange and that no returns are allowed?

I never do business with an entity that says they will only make exchanges, no matter how good the deal, because the deal is never that good. I learned my lesson on that a long time ago.

Another avenue would be to tell the store manager that you are going to file a claim with the better business bureau in your area. This usually works pretty good, because a lot of people check businesses out before purchasing high priced items, and the stores do not want this negative publicity. You can file a claim online. It only takes a few minutes.

We took pictures of the sag in the mattress and showed them to the salesman. Of course he was the new guy, only on the job two weeks. So he called his supervisor and said the pictures showed that the mattress was already sagging by at least one inch, along with all of the other problems. The manager stated the only solution was store credit.

I called customer service on Friday June 10, to have the mattress inspected to determine if it is defective. They still haven't called yet to "set up a convenient time" for the inspection. In the mean time my 28 day replacement time is ticking away.

Customer service told me again that he would either replace it or give me store credit but I will not get a refund.

I don't trust this company. If they are willing to deliver a defective mattress, why would I want a replacement from them? It's just a way for them to get even more of my money.

The credit card company is going to have to go back to Sleepy's to get their money because I'm not going to pay the credit card company for a defective mattress or store credit!!

I'll let you know if the mattress is ever inspected.

The mattress inspector was out yesterday and said the mattress had a 6 inch sag in it. Its the most he has every seen. They usually are 3 to 4 inches when they are replaced.

We still don't want it replaced! We want a refund so we'll see how that goes. We have to wait 10 days for the report to be issued before they will arrange pick-up of the mattress. And we can't "stain" it in the mean time or they won't replace it. I guess that's so they can deliver it to someone else!!

They called 24 hours prior to inspection. I imagined them calling and leaving this message on someone else’s machine. "The mattress inspector will be at your house sometime between 8 am and noon." Imagine the husbands response when the wife asked what was up with this message and why was their mattress being inspected and by whom??? I giggle every time I think of it.

By the way, how does one become a mattress inspector? I mean, wanting to grow up and be a compliance officer in one thing but wanting to have a job inspecting someone's 8 year old mattress??

Was your mattress a King size by any chance? Almost everyone I know, myself included, who has purchased a King size mattress has had problems with the first one or two that are delivered. This has been true regardless of the store where the mattress was purchased.

I suspect that King size mattresses have a high failure rate. You at least got quicker action than I did. It took us 7 months to get a replacement!!!!

Wow. I am curious to know what kind of mattress you purchased. I am about to do the same and I want one of those with the 'NASA' foam. What kind was yours??

Vee-We bought a TempurPedic a couple of years ago and we love it. We both have back issues and the mattress has been great. Takes a bit to get used to, but we think it was well worth it.

Our mattress was 100% latex. It's like the memory foam as it does conform to your body supposedly giving your body a good alignment as you sleep but it doesn't hold the heat. They put air pockets into the mattress to give added support, like springs.

I received a call from "management" saying how sorry they were for the problem we had with our purchase and when should they pick up the mattress. I asked it she had received the "sag" report and she said no but she would mail me a copy when it arrived. Now I'm really confused as to the big rush to make us happy and give us a refund. I'm guessing that the credit card company forwarded my complaint which landed on her desk. She was instructed to make the customer happy by refunding the purchase price.

They are picking up the mattress and frame today after 5 pm. My only fear is that they are going to repackage the defective mattress and sell it to someone else!!

I'm happy!! I'll be ecstatic once I receive the credit card bill with a zero balance. Good thing I read my disclosure from the credit card company and put my complaint in writing. I got some good results!!! It’s too bad they couldn’t take care of a compliant like that with the letter I wrote to the company June 9th. I wouldn’t have had to sleep on a defective mattress for another five weeks!

Hope to be sleeping well on a new mattress really soon!!

Well I got my mattress on Saturday. I got a Restonic with the 'Marvelous Middle' that has the memory foam. I must say that their claims that it keeps you cool in the summer are hogwash. I on one side and am cool on the other. When I turn over the mattress is extremely warm to my 'cooler' skin. I am wondering if a down mattress cover would make it any cooler. Now I must tell you that I am a very COLD person. I have a heater on at my desk all day. I am thin and for ME to be hot is really something!!! WHAT to DO???? I feel like a hot dog that needs to be turned over so I don't get burned on one side! I must be the only one in the world that thinks that foamy stuff is hot!!!!!!!

Have you considered trading in the matress for the less expensive one, and then using store credit to buy sheets/pillows/covers/bed frame, etc? Don't delay if they're willing to take it back.

You are not going to believe this!! They never picked the mattress up last night. The truck broke down at 7:30 pm and they stop working at 9 pm so they re-scheduled for tonight. Good thing I don't have anything better to do than sit around and wait for them.

I wish I could charge them an overnight storage fee.

They picked up the mattress on Tuesday night.

A local company delivered my new mattress on my lunch hour Wednesday and I had a good night sleep!!
