I recently purchased a mattress on a store credit card that the mattress company offered. I HATE the mattress and want to exchange it. Their company policy allows this, for a fee of course ($249.00). The problem is you need to get an even more expensive mattress. The one I like is $250 less than the one I originally purchased and the company will not work with me.

At this point I want to tell them to come pick up the mattress, I'll pay the 'exchange fee" in cash, and just not pay their credit card.

I'll go get my mattress from someone who actually wants my business.

I know regular credit cards offer consumers some protection if a product is defective or there is a problem. Does this work for a store card too?

I would read your contract statement. Does this card go through the visa/mastercard network?

The company is GE Money Bank out of Utah.

There is a section that states special rules for credit card purchases. If you have a problem with the quality of property or services that you purchased with a credit card and you have tried in good faith to correct the problem with the merchant, you may have the right not to pay the remaining due on the property or services.

These limitations do not apply if we own or operate the merchant.

How do I find out if GE Money Bank owns Sleep's?

We are going Thursday back to the store with a letter documenting the facts as we see them. We want them to remove the mattress and reverse the charge on their credit card.

What do you think my chances are for a happy ending?

How long have you had the mattress? Didn't it come with a limited time "satisfaction" guarantee? Usually mattresses do because you don't know if you are satisfied until you sleep on them for several days or even a few weeks. I know when I purchased my mattress set, it came with a 30-day satisfaction guarantee. If I didn't like it, I could return it and exchange it for another mattress, which I did. If you are past your period for this guarantee, then you are more than likely stuck with the offer the company has made.

We purchased it on May 23, 2005 and it was dilivered on May 24th.

On June 2nd, I told the salesman that we didn't like it.

He said our only option was to spend even more money at his store!

We do not want to continue to do business with this company. He stated we were required to sleep on it for 14 days before we could "exchange" it. We want to return it and walk away!!!

I'll let you know what he says after I meet with him Thursday night.

Call the Credit Card company direct. They can let you know if they can help you and what if any documentation they need from you.

Generally, your credit card company will back you up only if something was done wrong or the merchandise was not what it was supposed to be. Was their return policy posted at the register and/or on the receipt? Does it indicate that you must make an exchange and that no returns are allowed?

I never do business with an entity that says they will only make exchanges, no matter how good the deal, because the deal is never that good. I learned my lesson on that a long time ago.

Another avenue would be to tell the store manager that you are going to file a claim with the better business bureau in your area. This usually works pretty good, because a lot of people check businesses out before purchasing high priced items, and the stores do not want this negative publicity. You can file a claim online. It only takes a few minutes.
