my wife signed my name few times without my permission on my checks and on my credit card when she was using it

hello and please help... my mom forged 5 of my paychecks (i was in another state at the time)... my employer mailed my checks to her address, as i did not have direct deposit through the company... my mom claims i gave her permission to do this, but she has been so dishonest, that it's not suprising... if she forges a note too, as if i gave consent- how will this be handled, pleasea? is it illegal for her to sign my name with permission? i also had a savings opened in her name (to confuse this more!), on a temp. basis until i moved into her state... she was concerned over my financial stability,so i thought it a little measure to reassure her (i was fooled by her)... there's more details, but some of my cashiers checks to her for my savings account (in her name, out of her *best interest for me*) we not deposited either... any advice appreciated, and i apologise for confusion! rachel

I am an LMP who used to work for a chiropractor, I quit 3 months ago. Since then, he has been cashing/depositing my insurance reimburments checks that are payable to only me. These checks are being sent to the clinics address by mistake. Instead of forwarding them to my new address, he opens them, stamps them with the clinic name (or hand signs them) and takes them to the bank.

I have contacted the insurance companies and notified them of the situation and they have stopped payment on checks that have not been cashed. However, he has deposited upwards of a dozen checks and walked away with nearly $1,000 (that I am aware of so far!).

I asked his bank about their check cashing policy and they told me they do not cash/deposit checks made out to anyone other than the account holder. However, because the funds are being deposited into a business account, and there tends to be several checks deposited at one time, the name on the check isn't verified as closely.

This guy is intentionally stealing from me. I want to pursue prosecution. Do I hire a lawyer? Do I contact the authorities? I live in Washington State, where is the best place to start???

In both of the above matters, the best course of action is to file an affidavit of forged endorsement with the maker's bank. That bank will then forward the checks in question to the depository bank for reimbursement. Once the depository bank completes their investigation, and reimbursement would be issued to the maker's bank for credit to the maker's account. The maker can then use those funds to issue replacement checks.

Also, it is a good idea, once the affidavits are filed, to get copies of them and the checks in question, and file a report with the local police as well.

may i please just clarify? thank you.
i have copies of the checks she endorsed (to show who signed/made transaction) the bank mgr who recognised i was opening an account temporarily through mom told me to get these checks.
i've been to police chief, and he said i could handle it in civil litigation or go to her town/police dpt, and criminal charges (although, it's a *VILLAGE*) where mom lives...

so... i need to first contact where the checks were CUT? where the copies were sent from of the forged checks?

how will the maker get reimbursed through the investigation, please?

The police department that has jurisdiction over where your mother lives or where the bank that took the deposits is located should be able to handle this matter.

The affidavits will need to be filed with your employer's bank, because they are the bank that paid the checks. Because the endorsement on the checks is the issue, your employer's bank will send the items to your mom's bank for reimbursement. If your mom's bank determines through their investigation that a forgery took place, they will reimburse your employer's bank, who will then reimburse your employer, who will then reimburse you.

Keep in mind, that this is a walkthrough of the process. Other factors, such as the titling of your mom's account, the nature of any agreement between you, your mom, and her bank, and how the checks were negotiated, may affect the outcome of the bank's investigation.

You need to contact the maker of the checks, your insurance company. Tell them you never recieved the checks and your endorsement is not on the checks.

The should have you complete affidavits of forgery of endorsement for weach check and credit you. They in turn will reutrn the checks without entry to the bank of first deposit for proper endorsement or refund.

thank you! my mom **insisted** before i moved here on knowing my SSN. i asked her why, and she seriously responded, *in case we're ever separated again* well, i didn't think anything at the time, we were a family reunited... but i was moving to be near HER- later it seemed odd. so she has SSN, my DOB, her maiden name... i did telephone fraud alert on the three major companies... i've tried to mediate the issue, a demand letter was written- to no avail.. spoken to 2 police departments my town/hers... (civil-OR-criminal- two ways to handle this i'm told)... i wanted to stay OUT of court, and just have her pay back what's mine... small claims seems the way to go, yet there are criminal elements here (she clearly tried to conceal when the rest of my money she DIDN'T steal was left with a woman around the corner in a money order!! written out to herself!!!) that was fun getting cashed...she told me to *sign her name, if i want what she left me.* (from savings in parents name) it's unfair to the bank, my employer/bank, and me. i understand the weightiness of forgery/fraud penalties now. the checks came in the mail to her address... she opened my mail, forged my checks, and will say i gave permission- how, like power of attorney? there exists no conservatorship, payee, POA...

i appreciate ALL of this-- i'm trying to self-advocate... it's no small undertaking! reading a lot- repeat.repeat.repeat. apparently, parents told mediator they *Wish to keep this out of the public eye, and just get on with their own lives. (their daughter- me) is crazy.*

oh! i wanted to ask something else, please: to show that my cashiers checks made out to my mom for deposit into my savings (in parents name- i know now huge mistake), and the forged checks didn't benefit me, how to get copies of their account information, please? not the savings that was set up for MY money, that has been closed. their regular accounts which my funds must have reached. sorry for any confusion.
