I wrote a friend a check. I told her that I didn't have the money in my account but would be able to deposit my paycheck in a few days. She said to go ahead and write the check. She promised not to cash it until I had the money in the account. I decided to post date the check just in case. Well she cashed it and it bounced. Why? I post dated it. Isn't the bank supposed to wait until the date on the date the check to cash it?

The bank is not required to hold a check based on the date. Due to automated processing, most banks, if not all, do not even check the dates on the items. You need to talk to your "friend" about recouping your OD fee.

That was the old days. Presently, most state commercial codes (based on the UCC) have a provision, 4-401(c) that says:

"A bank may charge against the account of a customer a check that is otherwise properly payable from the account, even though payment was made before the date of the check, unless the customer has given notice to the bank of the postdating describing the check with reasonable certainty..."

You were wrong for writing a check when you know there was not enough money in the account to pay it.

Well at my bank we will not cash a post-dated check, which would have avoided your problem

Right Paul...if you catch that it is post dated you should not cash it, but if the check gets cashed anyway it is okay.

Basically we told our customers that there is really no such thing as a post dated check and they should not expect some one to hold a check that has been issued to them for payment.

your right to an extent, however if you did fail to look at the date, the check would still get processed

Who processes your checks for you? They look at every item, date, signature and amount? We need them to process for us!!!!!!!!

I wasn't in the last 2 days to defend myself but yes, I HAVE turned down checks that were post-dated...
