I have a business checkcard with my bank and noticed fraudulent charges on my account. My bank is telling me that the Visa Business checkcard agreement says I do not have chargeback rights or that they do not have to giv eme back my money. They say I am liable for all transactions whether it was authorized or unauthorized. There are over $10,000.00 worth of charges within two days all done in Louisiana.
I don't know if it helps but I am in Georgia.
Are business checkcards different from personal checkcards?
Please help.

Unfortunately for customers, Regulation E does not apply to business accounts. This regulation, which provides the protection for consumers for fraudulent charges, is a consumer regulation only.

When you received the card you should have been informed of these facts. Some banks, but not all, have an account agreement for the customer to sign. This is also not a requirement.

Please make sure your bank closes your card immediately, if they haven't already. You would not want to incur any additional lose.

Does anyone have a sample account agreement for business customers they would be willing to share? We are looking at offering debit cards to our business customers.

Anon, the bank I work at now does the same thing with business checkcards. It is not like a consumer card where the funds are basically protected.

However, in the case of fraud, if the customer wants we will dispute the charges with Visa but the customer will pay the charges from Visa...usually around $30 per dispute. Check with your bank to see if they have anything like this. You won't get a credit for the $10K while the investigation is going on but at least you may not lose the money totally.

My bank is willing to do the disputes, they charge $25.00 per chargeback. But I am still confused. My bank knows the card used was a counterfeit card because I have the original. How can they still hold me responsible for the charges? They gave me another copy of the Business Checkcard Agreement, I do not have the one sent with the card, it says in section 19 "Account holder agrees that it will be liable for all transactions to the Account arising from the use of the Card or PIN by you, regardless of whether said use was authorized or unauthorized." These transactions were not done by me. How can the agreement apply?

By signing the signature card for the account, you enter into a contractual agreement. You are in a sense, agreeing with the terms and conditions outlined by the agreement. You are legally bound to the contents within.

This section answers your question. You agreed to be liable for all transactions even if they are unauthorized. The counterfeit transactions fall into the unauthorized category. It's unfortunate that you may have to take the loss, but it looks like it was something you agreed to. Hopefully the bank will be able to recover at least some of the funds.
